When you signed a lease to rent premises, you will have also agreed to certain responsibilities regarding the maintenance and upkeep of the property. As the expiry date of your lease draws close, a landlord can choose to serve a formal Schedule of Dilapidations upon you, notifying defects and wants of repair under the lease.

However, they are under no compulsion to do so and often these are served after you’ve left. If so, you have no right to undertake these works yourself, rather you simply have to pay the landlord for the cost of the works and other associated costs. You may also have to pay rent for the time it takes them to undertake the works. Hence it can get very expensive very quickly.

It is therefore prudent to get advice from a Building Surveyor well before you intend to leave the premises.
